Alfred Toe | Homicide Watch Trentonhttp://trenton.homicidewatch.org/victims/alfred-toe/Latest news about Alfred Toeen-usMon, 20 Aug 2018 16:33:34 -0400Widow files wrongful death lawsuit against city and Trenton policehttp://trenton.homicidewatch.org/2018/08/20/widow-files-wrongful-death-lawsuit-against-city-and-trenton-police/<a href="http://wordpress.homicidewatch.org/trenton/files/2018/08/TPD.jpg"><img src="http://wordpress.homicidewatch.org/trenton/files/2018/08/TPD-300x261.jpg" alt="Trenton Police headquarters " width="300" height="261" class="size-medium wp-image-6747" srcset="http://wordpress.homicidewatch.org/trenton/files/2018/08/TPD-300x261.jpg 300w, http://wordpress.homicidewatch.org/trenton/files/2018/08/TPD.jpg 401w" sizes="(max-width: 300px) 100vw, 300px" /></a><p class="wp-caption-text">Trenton Police headquarters</p> <p>The wife of a man who was shot and killed by an off-duty cop two years ago has filed a civil lawsuit against the city and the police department. </p> <p>Kristi Williams, identified in court documents as the widow of <a href="http://trenton.homicidewatch.org/2016/08/28/authorities-investigating-police-involved-shooting-that-left-one-dead-in-trenton/">Alfred Toe</a>, filed a wrongful death lawsuit alleging that TPD Officer Sheehan Miles drank alcohol and “possibly” smoked marijuana prior to shooting Toe in the chest on August 27, 2016. <span id="more-6744"></span></p> <p>Most of the information contained in the lawsuit aligns with what law enforcement officials previously told the press, except for two key matters: the suit claims that there was no physical contact nor struggle between Toe and Miles prior to the gun discharging, and alleges that Miles was intoxicated at the time of the fatal encounter. </p> <p>Toe, 34, was shot and killed around 9:50 p.m. that night while attending a post-funeral gathering in the 500 block of Roosevelt Street. The lawsuit says Toe started arguing with someone else at the event and grabbed a gun out of his brother Constantine’s car. Constantine then confronted Alfred, documents state, which sparked a struggle during which time the gun “accidentally” fired, with a bullet striking Constantine’s hand. </p> <p>The lawsuit says Constantine had the situation under control and had retrieved the weapon from Alfred before Miles, who was also an attendee at the post-funeral gathering, approached them. </p> <p>According to the deadly force report issued by the county prosecutor’s office, Miles ordered Constantine onto the ground and confiscated the handgun he took from his brother. The officer was then holding both handguns, prosecutors say, when Alfred tried to grab one of the weapons from him. The report says “several witnesses” told law enforcement that Toe ignored commands to stand down, and that Miles actually punched Toe to create distance between the two of them. </p> <p>However, Alfred continued to disregard verbal commands and “persisted in his attempt to disarm” the cop, according to the prosecutor’s report, which says Miles “felt that he was losing his grip on the loaded firearm and fired one round,” striking Alfred in the chest.</p> <p>The lawsuit, however, disputes that account and claims Miles shot Alfred while telling him to “stand back” away from his brother, whom was on the ground being arrested. </p> <p>“Miles did not even finish the phrase when his weapon discharged and he shot Alfred Toe,” the lawsuit alleges. “There was no struggle between Miles and Alfred Toe.” </p> <p>The suit says Toe was at least five feet away from Miles when he was shot in the chest, and that law enforcement conspired to cover up what truly happened that night by not testing the cop for alcohol and marijuana. </p> <p>The county prosecutor’s office officially concluded that Miles was legally justified in using deadly force, as “he was acting to protect himself and others from imminent danger of death or serious bodily harm.”</p> <p>The report says that conclusion is based on statements from officers and witnesses, radio transmissions, body camera footage, photographs and physical evidence gathered at the scene. </p> <p>The Attorney General’s Office reviewed the prosecutor’s investigation and agreed with the conclusion of justified deadly force, therefore the case was never presented to a grand jury. </p> <p>Miles has since returned to the streets. </p> <p>TPD and the prosecutor's office declined to comment on pending litigation. </p> <p>Toe's widow is being represented by attorney Patrick Whalen. </p> Penny RayMon, 20 Aug 2018 16:33:34 -0400http://trenton.homicidewatch.org/2018/08/20/widow-files-wrongful-death-lawsuit-against-city-and-trenton-police/Alfred ToeMan killed by off-duty cop during struggle for a gun: Prosecutorshttp://trenton.homicidewatch.org/2016/08/28/authorities-investigating-police-involved-shooting-that-left-one-dead-in-trenton/<a href="http://wordpress.homicidewatch.org/trenton/files/2016/08/rsz_23285998.jpg"><img src="http://wordpress.homicidewatch.org/trenton/files/2016/08/rsz_23285998-500x375.jpg" alt="A man was shot and killed by an off-duty police officer here in the 500 block of Roosevelt Street. " width="500" height="375" class="size-large wp-image-4704" srcset="http://wordpress.homicidewatch.org/trenton/files/2016/08/rsz_23285998-500x375.jpg 500w, http://wordpress.homicidewatch.org/trenton/files/2016/08/rsz_23285998-300x225.jpg 300w, http://wordpress.homicidewatch.org/trenton/files/2016/08/rsz_23285998-768x576.jpg 768w, http://wordpress.homicidewatch.org/trenton/files/2016/08/rsz_23285998-800x600.jpg 800w, http://wordpress.homicidewatch.org/trenton/files/2016/08/rsz_23285998.jpg 864w" sizes="(max-width: 500px) 100vw, 500px" /></a><p class="wp-caption-text">A man was shot and killed by an off-duty police officer here in the 500 block of Roosevelt Street.</p> <p>A city man was shot and killed Saturday night after he allegedly tried to wrestle a handgun away from an off-duty police officer. <span id="more-4699"></span></p> <p>The incident happened around 9:50 p.m. Saturday in the 500 block of Roosevelt Street where the off-duty officer was attending a post-funeral gathering. </p> <p>Officials say 30-year-old Constantine Toe and his brother Alfred Toe, 34, attended the funeral and gathering as well. </p> <p>Prosecutors say Constantine was shot in the hand while trying to disarm Alfred during an altercation involving several men at the gathering, which prompted intervention from the officer. </p> <p>After hearing the gunshot, prosecutors say, an armed off-duty Trenton Police officer drew his weapon, ordered Constantine onto the ground and confiscated the handgun he took from his brother. </p> <p>The officer was holding both handguns, prosecutors say, when Alfred tried to grab one of the weapons from him. </p> <p>During the struggle, Alfred was shot once in the chest, according to prosecutors in the case. He later died at the hospital. </p> <p>Prosecutors did not disclose the name of the officer involved in the shooting. But several sources confirmed that Officer Sheehan Miles was the person who was struggling with Alfred when the gun fired. Sources say Miles was with a female companion, whom also attended the funeral and gathering, and that he was “very close-by” when he heard the shot that injured Constantine.</p> <p>Miles has been on the force for more than 13 years and earns a yearly salary of $91,871, according to public records. He suffered injuries to his arm and hand earlier this year while <a href="http://www.trentonian.com/article/TT/20160418/NEWS/160419729">breaking up a street fight</a> on North Broad Street. </p> <p>Dating back to 2013, there has been at least one police-involved shooting in the capital city each year.</p> <p>In May 2013, 38-year-old Gerald Murphy was shot and killed by police during a <a href="http://www.trentonian.com/article/TT/20130513/NEWS01/130519885">37-hour standoff</a> in a Grand Street home after he killed his girlfriend, her 13-year-old son, and held the woman’s three other children hostage at gunpoint. </p> <p>Then, in August 2013, Eric McNeil, 23, was justifiably shot and killed by police after he <a href="http://trenton.homicidewatch.org/2015/09/02/prosecutor-releases-report-on-2013-fatal-police-involved-shooting-in-trenton/">ambushed two detectives</a> as they were escorting a domestic violence victim back to her Hobart Avenue home. </p> <p>In November 2014, 31-year-old Darnell Stafford was shot and killed by cops after he <a href="http://trenton.homicidewatch.org/2014/11/13/man-dead-after-police-involved-shooting/">fired gunshots through the windshield</a> of their police cruiser on Wilson Street. </p> <p>And last year, police shot 23-year-old <a href="http://www.trentonian.com/article/TT/20150204/NEWS/150209899">Jeremiah Sanchez in the neck and arm</a> after he allegedly hit an officer with his car while fleeing from the first block of Chestnut Avenue. Sanchez survived the shooting. </p> <p>The Trentonian will include Toe's death in its yearly homicide count, and will differentiate between homicides and murders in its end of year review. But TPD and state police do not include justifiable police killings in yearly homicide statistics.
