He had the man’s truck towed for safe-keeping, he said, to preserve evidence. He said he immediately recognized him as Holman on the street.

“I saw his face, and he looked exactly like who I had been looking at,” Snyder said. “I was 100 percent positive.”

If that was the case, Furlong wanted to know why the detective originally thought the initial suspect he interrogated was the man from the grocery mart.

“We don’t just arrest people based off looks,” Snyder said.

“Isn’t that what you did with Michael Holman?” Furlong said.

Interrogations

Holman was interrogated twice on Feb. 26, 2014, the first time around 9:30 p.m. after he waived his Miranda rights.

Snyder told Holman he had information that he was involved with an “accident” in Chambersburg.

Furlong told the detective he lied to his client because he knew what happened to Cruz wasn’t an accident.

“I didn’t lie to him,” Snyder said. “He may have been able to provide an explanation. Maybe it wasn’t murder. I don’t want to be like, ‘You murdered him.’ It could have been accident. It could have been murder. It could have been something fell outside of the sky and [Holman] was standing there.”

Julio Cesar-Cruz

The interview ended when Holman told detectives he was on juvenile probation, had an ankle bracelet that monitored his whereabouts and asked police to verify that with his probation officer and attorney.

“My curfew is 7,” Holman said. “I’m usually home or with my daughter. I don’t really get into nothing.”

After the first interview ended, Snyder met with supervisors to decide whether to charge Holman.

A crime scene detective was called in to collect Holman’s clothes.

What happened next is in question.

Detective Sgt. Christopher Doyle emerged from the interview room and told Snyder that Holman asked to speak a second time.

The exchange between Doyle and Holman was not caught on tape, which is why Furlong has challenged whether the second statement was voluntary.

During the second interview, Holman admitted being near the murder scene, prosecutors said.

The hearing resumes in August.
Isaac AviluceaWed, 29 Jun 2016 16:10:04 -0400http://trenton.homicidewatch.org/2016/06/29/attorney-for-suspect-in-latino-mans-murder-says-detective-misidentified-client/Julio Cesar CruzMichael HolmanDante MartinJudge raises security questions at status hearing for beating death in Trentonhttp://trenton.homicidewatch.org/2015/06/29/judge-raises-security-questions-at-status-hearing-for-beating-death-in-trenton/
A status hearing Monday for one of two men accused in the brutal beating death of a Guatemalan immigrant took an unexpected turn when the judge stepped off the bench and summoned one of his sheriff’s officers to a sidebar.

Michael Holman

When Superior Court Judge Robert Billmeier returned to the bench, he said he was concerned about the security of his court room being “compromised,” an apparent reference to a man who had entered, left and re-entered the courtroom during a court appearance for 19-year-old Michael Holman.

The man’s relation to Holman was unclear, but Holman waived to him as he was being led away following the hearing.

The man appeared confused by the judge’s remarks as he had already been wanded down before entering the courtroom, a member of the judge’s security team said.

Holman is charged along with Dante Martin, also 19, for the Feb. 14, 2014 beating death of Julio Cesar Cruz, which caused uproar in the city’s Latino community.

Holman was offered a plea deal that requires him to serve 31 years if he pleads guilty to aggravated manslaughter and aggravated assault.

Assistant Prosecutor James Scott was asked by the judge whether Holman made any incriminating statements to authorities and responded “very much so.”

Holman’s attorney, Jason Charles Matey, expressed frustration that he has not been able to watch voluminous surveillance footage related to the case with his client because of security policies in place at the Mercer County jail where Holman is being held.

Julio Cesar-Cruz

The unexpected hitch has prevented Matey from inching the case toward a resolution since he doesn’t anticipate filing many motions on behalf of his client.

Billmeier said he planned to intervene in the matter.

Matey must review hundreds of hours of footage with his client before Holman can decide whether he wants to take his case to trial. Holman was arrested in close proximity to where the homicide occurred. Martin was charged at the prosecutor’s office.

The arrests are result of a tenacious investigation by the Mercer County Homicide Task Force. Through witness interviews, neighborhood canvassing, and viewing hours and hours of surveillance video downloaded from local businesses, officers were able to identify and locate the suspects.

“The arrest made in this case are in very large part due to the assistance offered by local businesses through access to their video systems, and the willingness of concerned citizens to step up and be heard,” Prosecutor Bocchini said. He also praised the tireless efforts of the homicide task force and its use of old fashioned police work in developing information to identify and charge Holman and Martin.

“I commend the outstanding efforts put forth by members of the Mercer County Homicide Task Force identifying and bringing to justice those individuals responsible for this senseless act,” TPD director Rivera said. “As police director of the city of Trenton, I reaffirm my commitment to the community by continuing to work with the residents of the city. Together, we can bring forth positive change and improve our quality of life so we can all live without fear.” Rivera added.

Nineteen-year-old Julio Cesar Cruz was returning to his Rusling Avenue home in South Ward Trenton at approximately 6:45 p.m. on Saturday, Feb. 15, when he was approached by two assailants in an apparent robbery attempt.

The victim was able to bang on the front door and call for help. Another resident of the home immediately looked out a window and saw the two assailants throw the victim to the ground, causing what would become a fatal head injury. When other people inside of the home came out to assist Cruz, the assailants fled in different directions. Both Holman and Martin are being held in the Mercer County Correction Center in lieu of $1 million bail.

The task force has been operating since November 2013. Under the command of Mercer County Prosecutor’s Captain Robert Dispoto and Lieutenant Rich Frascella, the task force is comprised of officers with the prosecutor’s office, the Mercer County Sheriff’s Office, the New Jersey State Police, and the Lawrence, Trenton and West Windsor police departments. Assistant Prosecutor James Scott is prosecuting the case.
Trentonian StaffThu, 27 Feb 2014 17:44:56 -0500http://trenton.homicidewatch.org/2014/02/27/citizens-help-catch-suspects-in-murder-of-julio-cruz/Julio Cesar CruzMichael HolmanDante MartinCommunity bids farewell to slain teenhttp://trenton.homicidewatch.org/2014/02/22/community-bids-farewell-to-slain-teen/
BY CARLOS AVILA cavila@trentonian.com

On an unusually warm Saturday evening, Julio Cesar Cruz was laid to rest at Chiaccho Funeral Home in Trenton’s South Ward as hundreds of community members came to say farewell to the slain teen.

Last week Cruz, 19, was beaten to death in front of his Rusling Street home while returning from a nearby deli where he went to buy groceries. Cruz, came to the United States from Guatemala less than three months ago seeking the American Dream. At around 9 p.m. on Feb. 15, Cruz was pronounced dead upon arrival to St. Francis Medical Center.

Cruz’s death was felt across the city and galvanized the local Latino community. On Wednesday, more than 350 people attended a peace rally asking for justice to be done in Cruz’s case and an end to violence in the city.

“I want justice for my brother, all he did was go get some food and get ready for his first day of work, he did not deserve this,” said the victim’s brother Jose Antonio Cruz.

According to Antonio Cruz, who came from Tennessee after being notified of his brother’s death, Julio Cesar Cruz was excited to have a found a job at a nearby car wash.

“Our parents back home need financial help and between my brother and I, we were going to help send money back home to Guatemala,” added Cruz.

The funeral for Cruz carried the energy from the rally earlier in the week as community members gathered for the funeral.

“I never met him, but he is a fellow Guatemalan who suffered a similar fate that many of us almost have. I have also been attacked,” said David Godoy from Assemblies of God Church who sang at the funeral home and came to give his respects to Cruz’s family.

“We are hurting as a community, we needs things to change,” said Godoy.

Cruz’s death has brought many victims in the Latino community together and given them an opportunity to speak up against the type of violence they feel has been targeted against Latino immigrants recently
Trentonian StaffSat, 22 Feb 2014 20:55:44 -0500http://trenton.homicidewatch.org/2014/02/22/community-bids-farewell-to-slain-teen/Julio Cesar CruzSlain teen's brother vows to see justice donehttp://trenton.homicidewatch.org/2014/02/18/slain-teens-brother-vows-to-see-justice-done/
By Carlos Avila, The Trentonian

Saturday’s killing of 18-year old Julio Cesar Cruz in Trenton’s Chambersburg section has garnered national attention as the details of the incident continue to emerge.

According to his roommates, at around 6:30 p.m., Cruz went to a bakery on Whittaker Avenue to buy his take-out dinner. Twenty minutes later as he approached his house on the way back, two African-American males with hoodies grabbed him and started beating him.

It is not known if the assailants intended to rob Cruz or inflict injury. Cruz lost conscience and hit his head on the concrete porch of his home.

A roommate of Cruz says that he ran after one of the assailants and was able to catch up with him. “When I caught up to him I hit him with a plastic shovel I took with me. After hitting him in the back with the shovel he turned around and raised his arms in surrender, but as I looked back to see if Cesar was getting up the kid just took off,” the roommate, who wished to remain anonymous for fear of retaliation, said in Spanish.

The roommate returned to the scene of the accident to find Cruz unconscious and without signs of life. Cruz was declared dead upon arrival at St. Francis Medical Center in Trenton.

As the week began several community leaders and news agencies descended upon the corner of South Clinton Avenue and Rusling Street in Trenton to learn more about the incident and offer help.

Cruz’s older brother traveled over night from Tennessee to put his younger brother to rest.

“I am devastated by the death of my brother,” said Jose Antonio Cruz. “We would talk every day by phone. The last time we talked, he was so excited because he got a job at a car wash,” said the brother, choking back his tears.

“I want justice for my brother and I will not leave Trenton until we get justice,” he added.

Residents of Chambersburg continue to be fearful as a result of the increase in targeted assaults against Latino immigrants, who seem to be perceived as vulnerable.

“It is very dangerous in this city. I told Julio Cesar to be careful when going out because people are out looking to rob us,’ said a neighbor Wilmer Lopez. “The truth is ... these kids are hurting us and they are hurting themselves. I also got robbed,” he added as he pointed to a scar on his forehead.

Another roommate who picked up Cruz’s body to look for signs of life says she is traumatized by the experience.

“I am so sad and can’t stop thinking about it. This was a young man full of life who came to this country with dreams to work and help his family. When I knelt down on the floor I took his head in my arms and I realized he was dead. I looked for a pulse and did not feel anything,” said Magnolia Lopez who helped Cruz get settled when he arrived to the United States from Guatemala.

Latino community activists noted that they are planning to organize a rally in front of city hall.

“Stop attacking our community — enough is enough. Please do not ignore our Latino community,” said Roberto Hernández, executive director of El Centro.

The Trenton Police Department had not additional information on Monday.

Anyone who wants to help the victim’s family, can call to Guatemalan Civic Association’s president Elemer Sandoval, (609) 532-9325.

Anyone with information on the attack is asked to call the Mercer County Homicide Task Force (609) 989-6406, or use the Trenton police confidential tip line at (609) 989-3663.
Trentonian StaffTue, 18 Feb 2014 01:09:07 -0500http://trenton.homicidewatch.org/2014/02/18/slain-teens-brother-vows-to-see-justice-done/Julio Cesar CruzFamily, neighbors alarmed by beating death of South Ward teenhttp://trenton.homicidewatch.org/2014/02/16/family-neighbors-alarmed-by-beating-death-of-south-ward-teen/<img class="size-small wp-image-1417" alt="A friend shows the photo of Julio Cesar Cruz.
